Council Housing Disrepair
Local councils have a fundamental duty to provide their tenants with safe, habitable and well- maintained housing. When a council rents out a property, it assumes the responsibility of ensuring that it meets legal standards for health and safety. This obligation includes keeping the structure of the building in good repair, maintaining heating, plumbing and electrical systems, as well as addressing issues such as damp, mould, leaks and pest infestations.
The Landlord and Tenant Act 1985 establishes that rented homes must be fit for human habitation. The Homes (Fitness for Human Habitation) Act 2018 reinforces this by giving tenants legal recourse when properties fall below acceptable standards. Local authorities must ensure compliance with these laws and have a duty to act on hazards under the Housing Act 2004, which introduced the Housing Health and Safety Rating System (HHSRS) to assess risks within rental properties.
Reporting Disrepair – Notify Your Council
If a tenant notices disrepair in their home, they should report the issue to the council’s housing department as soon as possible, preferably in writing, keeping copies of all correspondence. The council is expected to investigate and arrange for necessary repairs within a reasonable timeframe. What qualifies as ‘reasonable’ depends on the severity of the issue. Emergencies such as major leaks or electrical faults should be dealt with immediately, while non-urgent repairs may take longer but should still be completed within an acceptable period. If repeated complaints do not result in action, tenants have several avenues to pursue. They can escalate the issue by making a formal complaint through the council’s own complaints procedure. If this does not lead to a resolution, they may contact the Housing Ombudsman, who has the authority to investigate cases of neglect or failure to act. Another option is to report serious hazards to the local Environmental Health department, which can conduct inspections and issue enforcement notices if necessary. In cases where the council remains unresponsive, tenants may take legal action, seeking compensation for inconvenience, distress, or financial losses caused by the disrepair.
Some tenants may worry that making complaints could put them at risk of eviction or retaliation from the council. While council housing tenants have greater protection from so-called retaliatory evictions than those renting from private landlords, concerns still exist. It is unlawful for a council to evict a tenant simply for raising concerns about disrepair, and tenants who suspect they are facing unfair eviction should seek legal advice as soon as possible. If eviction proceedings are initiated, tenants may be able to challenge them on the grounds of unfair treatment. Withholding rent, which some tenants may feel justified in doing in these situations, is generally not advisable, as it can place the tenant in breach of their tenancy agreement and would then provide legal grounds for eviction. Instead, tenants should continue paying rent while following formal complaints procedures and as has been mentioned, seek legal advice as soon as possible.
Housing disrepair claims can be made nationwide. However, some of the larger councils include the following –

Croydon Council
Dudley Metropolitan Borough Council
